Ofeliya Isayeva Wins The Case At The European Court Of Human Rights

June 25, the European Court of Human Rights upheld the claim against the Azerbaijani citizen, Ofelia Isayeva.

Isayeva was charged with fraud and illegal possession of narcotic substances and sentenced to ten years' imprisonment in 2010. The applicant appealed against this judgment.

On 5 August 2012, while her appeal was pending before the Baku Court of Appeal, the applicant died in prison. Following Isayeva's death, her sister, Ms Sevil Rzayeva, took the case to the European Court of Human Rights.

The court concluded that there has been a violation of Articles 5.1 and 5.3 of the Convention and that the respondent State pays Sevil Rzayeva, EUR15,500 in respect of non-pecuniary damage, costs and expenses.
